1. Important Summary

FanKix is a country-themed fan gear store with a free arcade loyalty experience.

KIX are FanKix loyalty points. KIX are not money, not cash, not a debit balance, not a gift card, not cryptocurrency, not a stored-value account, and not a financial product. KIX cannot be purchased, sold, transferred, withdrawn, exchanged for cash, staked, wagered, multiplied, or used outside eligible FanKix rewards and discounts.

FanKix is not a gambling website, casino, sportsbook, betting service, lottery, sweepstakes casino, or wagering platform. FanKix does not offer cash prizes, betting, wagering, deposits, withdrawals, odds, or gambling services.

Paid FanKix products, passes, ad-free upgrades, memberships, or season passes do not increase your arcade KIX earning rate, do not provide extra KIX-earning attempts, do not improve KIX outcomes, and do not improve your eligibility for KIX Drops or other redeemable rewards.

2. Eligibility and Age Rules

You may browse the FanKix store and play FanKix Arcade as a guest without creating an account.

FanKix Arcade Pass accounts are available only to users who are 13 years of age or older. You must provide accurate age information when activating a FanKix Arcade Pass.

Users under 13 may continue to play FanKix Arcade as guests, but they may not create a FanKix Arcade Pass account, save or redeem KIX, join public leaderboards, use referrals, participate in KIX Drops, or access other account-based reward features.

If you are under the age of majority in your location, you may use FanKix only with permission from a parent or legal guardian. Purchases by minors must be made with parent or guardian permission.

If FanKix learns that an account belongs to a user under 13, FanKix may disable the account, remove the user from leaderboards or referrals, delete or anonymize associated personal information, and cancel access to saved KIX or reward features.

3. Guest Play

FanKix Arcade may allow guest play without signup. Guest play is for entertainment only.

Guest play may display session progress, scores, “session KIX,” “potential KIX,” or estimated rewards. Guest session progress is not a permanent KIX balance and cannot be redeemed unless an eligible user activates a FanKix Arcade Pass account.

FanKix may use a temporary guest session identifier to operate the arcade, prevent abuse, manage game sessions, and display session progress. A guest session does not create a permanent account, public profile, referral account, or redeemable KIX balance.

FanKix may limit, reset, expire, erase, or refuse to transfer guest session progress at any time.

4. FanKix Arcade Pass

A FanKix Arcade Pass is an account-based feature that lets eligible users save KIX, view eligible KIX activity, redeem eligible KIX, join permitted leaderboards, and use other approved FanKix Arcade features.

To activate a FanKix Arcade Pass, you may be required to provide age information, create an account, verify your login method, and accept these Terms and the Privacy Policy.

The FanKix Arcade Pass is not a debit card, credit card, bank account, gift card, prepaid card, stored-value card, crypto wallet, or payment account. Any “token,” “pass,” “card,” or similar wording used by FanKix refers only to a FanKix account or loyalty feature, not to a financial account.

5. KIX Loyalty Points

KIX are promotional loyalty points issued by FanKix. KIX may be earned through eligible free arcade activity, eligible promotions, eligible referrals, ordinary store loyalty activity, or other FanKix-approved loyalty actions. Purchases may earn ordinary store loyalty KIX if FanKix offers that benefit, but paid arcade passes, ad-free upgrades, memberships, season passes, or paid digital features do not increase arcade KIX earning, KIX outcomes, KIX Drop eligibility, or leaderboard status.

KIX have no cash value. KIX are not your property. KIX do not create any bank, trust, stored-value, escrow, gift card, prepaid access, or financial relationship.

You may not buy KIX. You may not sell KIX. You may not transfer KIX to another person. You may not trade KIX. You may not withdraw KIX. You may not stake, wager, risk, multiply, or gamble with KIX. You may not exchange KIX for cash, gift cards, crypto, third-party value, or anything outside approved FanKix rewards and discounts.

FanKix may cap, limit, adjust, expire, reverse, suspend, or cancel KIX at any time to prevent fraud, abuse, technical errors, legal risk, payment processor issues, or violation of these Terms.

KIX may be subject to daily, weekly, monthly, seasonal, yearly, account-based, household-based, device-based, geographic, redemption, or promotion-based limits. FanKix may also set maximum KIX earning, saving, or redemption amounts for any period or promotion.

KIX may not be earned through cheating, automation, bots, scripts, multiple-account abuse, referral abuse, VPN abuse, emulator abuse, exploit use, fake traffic, ad fraud, or other activity FanKix considers suspicious or unfair.

FanKix may refuse to honor KIX that FanKix believes were earned through error, abuse, fraud, unauthorized activity, or violation of these Terms.

6. No Paid KIX Advantage

FanKix may sell products, ad-free passes, digital cosmetics, season passes, badges, skins, profile features, or other entertainment/status features.

No purchase is required to play eligible free FanKix Arcade games or earn eligible free arcade KIX. Making a purchase, buying a pass, or using an ad-free feature will not improve arcade KIX outcomes, KIX earning, or KIX Drop eligibility.

Paid products, paid passes, ad-free upgrades, memberships, or season passes do not increase arcade KIX earning, do not provide extra KIX-earning attempts, do not improve KIX outcomes, do not improve KIX Drop eligibility, do not improve leaderboard status, and do not provide cash or cash-equivalent rewards.

If FanKix offers paid digital features, those features are for entertainment, access, cosmetics, convenience, ad-free access, or status only. Paid digital features are not a way to buy KIX, win KIX, increase KIX earning, reroll KIX outcomes, or improve KIX Drop eligibility.

7. Arcade Games

FanKix Arcade games are for entertainment and loyalty engagement. FanKix may add, remove, modify, pause, rebalance, or limit games at any time.

Game outcomes, scores, KIX amounts, Rep Score, Country Score, badges, cosmetics, or other features may be adjusted to prevent abuse, correct errors, maintain fairness, comply with laws or platform rules, or protect FanKix.

FanKix may use skill-based, trivia-based, timing-based, arcade-style, casual, or promotional game formats. FanKix may also offer free daily loyalty bonus features, such as a daily kick, daily check-in, or similar daily reward reveal. These features are free, limited, capped, and promotional; users may not pay for retries, rerolls, improved outcomes, or extra KIX-earning claims unless FanKix clearly states that no KIX or redeemable value is involved.

FanKix does not offer gambling, wagering, betting, deposits, withdrawals, cash prizes, or games where users stake money or KIX for a chance to win cash, cash-equivalent value, discounts, products, KIX, or other redeemable value.

8. Rep Score, Country Score, and Leaderboards

FanKix may offer leaderboards, rankings, Rep Score, Country Score, badges, titles, visual effects, public recognition, or similar status features.

Leaderboards are for recognition, status, and entertainment only. Leaderboard placement does not award KIX, cash, products, store credit, discounts, prizes, KIX Drops, or other redeemable value.

FanKix may remove users from leaderboards, adjust leaderboard scores, reset leaderboards, hide usernames, moderate country rankings, or cancel leaderboard features at any time.

FanKix may use separate non-redeemable status points, such as Rep Score or Country Score, for rankings. These points are not KIX, have no cash value, and cannot be redeemed.

9. Match Predictions

FanKix may offer match prediction, fan voting, confidence meters, prediction streaks, or similar sports-related entertainment features.

FanKix match predictions are for entertainment, community engagement, badges, streaks, non-redeemable status, or non-redeemable Country Score only.

FanKix match predictions do not involve betting, wagering, odds-making, deposits, withdrawals, cash prizes, sportsbook services, fantasy sports cash prizes, or gambling.

Correct predictions do not award KIX, cash, products, store credit, discounts, KIX Drops, or other redeemable value. Match predictions are for entertainment, streaks, badges, Rep Score, Country Score, fan voting, and non-redeemable status only.

10. KIX Drops

FanKix may offer limited KIX Drops where eligible users may redeem KIX for selected FanKix items or rewards while supplies last.

KIX Drops are loyalty redemptions, not cash prizes, gambling winnings, sweepstakes prizes, contest prizes, leaderboard prizes, or betting payouts. KIX Drops are not awarded because of leaderboard placement, match prediction results, paid pass ownership, or paid gameplay access.

KIX Drops may be limited by account, household, shipping location, age, inventory, fraud checks, KIX balance, redemption limits, or other eligibility rules. FanKix may cancel, modify, substitute, limit, or end any KIX Drop at any time.

Any sweepstakes, giveaway, random drawing, contest, or special promotion that is separate from ordinary KIX redemption may have separate official rules. If separate official rules apply, those rules control that promotion.

KIX Drops may sell out. KIX Drop inventory is not guaranteed. FanKix may reject or cancel a redemption if FanKix believes the KIX was obtained through fraud, abuse, error, botting, multiple-account activity, or violation of these Terms.

Shipping charges, taxes, duties, address restrictions, or other charges may apply to physical KIX Drop items unless FanKix clearly states otherwise.

11. Referrals and Affiliate Activity

FanKix may offer referral programs, affiliate programs, game partner programs, creator partnerships, sponsored placements, or similar programs.

Referral or affiliate rewards may be limited, changed, paused, or canceled at any time. FanKix may reverse rewards connected to fake accounts, self-referrals, bots, spam, misleading posts, undisclosed paid promotion, or abuse.

If you promote FanKix and receive or may receive payment, KIX, free products, discounts, commissions, referral rewards, affiliate rewards, sponsorships, or any other benefit, you must clearly disclose your relationship to FanKix in a way that ordinary people can understand.

FanKix may require separate written agreements for affiliates, creators, game partners, sponsors, or developers. No person may upload, submit, or provide games to FanKix unless FanKix approves the game and the partner agrees to FanKix’s partner rules.

Game partners must own or have legal rights to all game content they provide. Partner games may not include gambling mechanics, unauthorized intellectual property, malware, deceptive ads, unauthorized data collection, adult content, illegal content, or content FanKix considers unsafe or inappropriate.

12. Ads and Ad-Free Features

FanKix may show ads on the website or arcade pages, including ads served by third-party providers.

You may not click ads repeatedly, encourage others to click ads, use bots or automation to create ad views or clicks, hide or manipulate ads, or engage in ad fraud.

FanKix may offer an ad-free pass or reduced-ad experience. An ad-free pass removes or reduces certain FanKix Arcade ads, but may not remove all third-party notices, transactional messages, platform messages, checkout notices, legal notices, or required service communications.

Ad-free passes do not increase KIX earning and do not improve KIX Drop eligibility.

13. Accounts and Security

You are responsible for keeping your account login secure. Do not share your account, sell access, use another person’s account, or create accounts with false information.

FanKix may require verification, email verification, SMS verification, age confirmation, fraud checks, account review, or other security measures before allowing KIX saving, KIX redemption, KIX Drops, leaderboard access, referrals, account recovery, or purchases. FanKix may refuse, delay, reverse, or cancel KIX activity if verification is not completed or if fraud, abuse, botting, duplicate accounts, false age information, or suspicious activity is suspected.

FanKix may suspend or terminate accounts that FanKix believes are involved in cheating, fraud, bots, fake traffic, exploitation, harassment, abuse, false age information, payment fraud, chargeback abuse, intellectual property misuse, or violation of these Terms.

14. Purchases, Payments, and Checkout

FanKix products and passes may be purchased through Shopify Checkout, Shop Pay, PayPal, or other approved payment providers.

FanKix does not ask you to provide credit card numbers directly inside the FanKix Arcade. Payment card information is processed by third-party checkout and payment providers.

Prices, product availability, discounts, promotions, shipping times, and taxes may change at any time.

FanKix may refuse, cancel, or refund orders for suspected fraud, pricing errors, stock issues, payment risk, abuse, violation of these Terms, or other legitimate business reasons.

Digital products, passes, cosmetics, badges, skins, ad-free upgrades, or season passes may be non-refundable once delivered or activated, except where required by law or expressly stated by FanKix.

15. Shipping, Returns, and Refunds

Shipping times are estimates and are not guaranteed unless FanKix expressly states otherwise.

FanKix may provide separate Shipping Policy, Return Policy, and Refund Policy. Those policies are part of these Terms.

If a product contains food, hygiene-sensitive goods, customized items, limited drops, digital items, or other special items, return eligibility may be limited for safety, customization, or legal reasons.

Return requests must follow the Return Policy posted on FanKix at the time of purchase.

16. Intellectual Property

FanKix, the FanKix name, logos, designs, website, arcade, KIX system, graphics, text, badges, skins, animations, code, layouts, product designs, and other content are owned by FanKix or its licensors.

You may not copy, reproduce, resell, scrape, reverse engineer, modify, distribute, or use FanKix content without written permission.

FanKix is not affiliated with, sponsored by, endorsed by, or officially connected to FIFA, the World Cup, soccer federations, leagues, clubs, teams, players, athletes, or any other third-party rights holders unless FanKix expressly states an official relationship in writing.

Country-themed designs are intended as original fan-inspired designs. You may not use FanKix to sell or submit counterfeit goods, unauthorized team logos, player likenesses, copyrighted content, trademarks, or other content that violates third-party rights.

If you believe content on FanKix violates your intellectual property rights, contact fankixus@gmail.com with enough information for FanKix to review the claim.

17. User Content

If FanKix allows you to submit usernames, comments, reviews, country selections, profile content, game content, images, videos, or other content, you grant FanKix a non-exclusive, worldwide, royalty-free license to use, display, reproduce, modify, moderate, remove, and distribute that content in connection with FanKix.

You are responsible for your content. You may not submit content that is illegal, hateful, harassing, misleading, infringing, adult, violent, spammy, deceptive, or harmful.

FanKix may remove or moderate user content at any time.

18. Prohibited Conduct

You may not:

• Use FanKix for gambling, wagering, betting, odds-making, cash prizes, or unauthorized contests.
• Buy, sell, trade, transfer, withdraw, stake, wager, risk, multiply, or gamble with KIX.
• Use bots, scripts, automation, macros, emulators, exploits, fake traffic, or multiple-account abuse.
• Manipulate games, scores, leaderboards, referrals, ads, checkouts, discounts, KIX balances, KIX outcomes, daily rewards, or KIX Drops.
• Provide false age information.
• Create accounts for users under 13.
• Harass, threaten, impersonate, or abuse others.
• Upload malware or interfere with FanKix systems.
• Violate intellectual property rights.
• Misrepresent FanKix as officially affiliated with any team, league, player, federation, event, or brand.
• Use FanKix for illegal activity.

19. Changes to FanKix and These Terms

FanKix may update, modify, suspend, or discontinue any part of the Service at any time, including KIX earning, KIX redemption, leaderboards, games, ads, passes, drops, referrals, products, promotions, and account features.

FanKix may update these Terms from time to time. The updated Terms will be posted with a new effective date. Your continued use of FanKix after changes means you accept the updated Terms.

20. Disclaimers

FanKix is provided “as is” and “as available.” FanKix does not guarantee that the Service will be uninterrupted, error-free, secure, available at all times, or free from bugs, technical problems, game errors, scoring errors, KIX errors, ad errors, or checkout issues.

FanKix does not guarantee that any user will earn KIX, redeem KIX, qualify for a KIX Drop, appear on a leaderboard, receive a discount, or obtain any particular product.

21. Limitation of Liability

To the maximum extent permitted by law, FanKix and its owners, officers, employees, contractors, partners, suppliers, and service providers will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including lost profits, lost data, lost KIX, lost discounts, lost opportunities, account loss, leaderboard loss, or loss of goodwill.

To the maximum extent permitted by law, FanKix’s total liability for any claim related to the Service will not exceed the greater of: (a) the amount you paid FanKix for the product or service giving rise to the claim in the 3 months before the claim, or (b) $100.

Some jurisdictions do not allow certain limitations, so some limitations may not apply to you.

22. Indemnification

You agree to defend, indemnify, and hold harmless FanKix and its owners, officers, employees, contractors, partners, suppliers, and service providers from claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising from your use of FanKix, your content, your violation of these Terms, your violation of law, your fraud or abuse, your misuse of KIX, your infringement of third-party rights, or your unauthorized promotion or partnership activity.

23. Dispute Resolution

Before filing a claim, you agree to contact FanKix at fankixus@gmail.com and try to resolve the dispute informally.

To the maximum extent permitted by law, disputes will be handled individually and not as a class action, collective action, or representative action.

24. Governing Law

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law rules, unless your local consumer protection laws require otherwise.
